These Terms and Conditions of Sale ("Terms") govern your use of the website and any purchases you make from Firehole LLC, including its operating divisions: Firehole Arms and Firehole Ordnance. By accessing our website or purchasing products, you agree to be legally bound by these Terms.
1. Parties and Scope of the Agreement
- Binding Agreement: "These Terms constitute a legally binding agreement between you and Firehole LLC, including its wholly-owned subsidiaries and operating divisions: Firehole Arms LLC, Firehole Ordnance LLC, and Dark Hills LLC (collectively referred to as 'Firehole,' 'We,' 'Us,' or 'Our')."
- Products Covered: These Terms apply equally to all products offered for sale by Firehole, including Firearms, Ammunition, Components, Powder, and Primers.
2. Eligibility and Legal Compliance
- Age Requirements: By placing an order, you certify that you meet the following minimum age requirements as dictated by Federal law:
- 21 years of age to purchase Handguns and Handgun Ammunition.
- 18 years of age to purchase Rifles, Shotguns, and Rifle/Shotgun Ammunition.
- 21 years of age to purchase All Firearms (to comply with FFL transfer requirements).
- Prohibited Persons: You confirm that you are not prohibited from purchasing or possessing firearms or ammunition under Federal, State, or Local law.
- Compliance Responsibility: You are solely responsible for knowing and complying with all Federal, State, and Local laws concerning the transfer, ownership, and use of the purchased items.
- Ammunition Shipping Restrictions: We do not ship ammunition to Alaska, Hawaii, California, Connecticut, the District of Columbia, Illinois, Massachusetts, New Jersey, or New York. By placing an order for ammunition, you certify that your shipping address is not located in any of these prohibited jurisdictions.
3. Intellectual Property, Trademarks, and Copyright
- Our Property: All content on this website, including text, graphics, logos, images, and the trademarks Firehole LLC, Firehole Arms, and Firehole Ordnance, are the exclusive property of Firehole LLC or its suppliers and is protected by United States and international copyright and trademark laws.
- Third-Party Property: The trademarks, copyrights, and intellectual property of all products sold but not manufactured by Firehole (e.g., component brands, firearm brands) remain the exclusive property of their respective owners. You are granted no license or right to use any third-party intellectual property found on this site.
4. Products, Safety, and Strict Warranty Disclaimer
- Manufacturing Standards: All cartridges are manufactured by Dark Hills LLC (Federal Type 7 Manufacturer). While we guarantee the exercise of reasonable care in manufacturing, we assume no responsibility beyond the replacement of the product itself.
- Mandatory Safety Protocols: By purchasing and using our ammunition, you agree to strictly adhere to the following safety protocols. Failure to do so constitutes product misuse and an assumption of risk:
- Strict Inspection: Use only in modern firearms in good condition, originally chambered for this specific cartridge.
- Immediate Cessation of Use: If you experience any abnormality—including light recoil, unusually loud or weak sound, or a "bolt lockup"—you must immediately stop using that ammunition batch. You have a duty to inspect the barrel for obstructions before proceeding.
- No Liability for Subsequent Use: We disclaim all liability for damage or injury if you continue to fire ammunition after a known malfunction or "bad lockup" occurs.
- Storage Requirements: Ammunition must be stored in a cool, dry place. We are not responsible for product performance issues resulting from improper storage or exposure to environmental extremes over time.
- Reloading Disclaimer: Since reloading practices are beyond our control, we disclaim all liability for damage resulting from pulled, tampered, or reloaded components.
- Warranty Disclaimer: FIREHOLE LLC MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. You rely solely on the original manufacturer for any claims related to material defects.
5. Pricing, Payment, and Order Acceptance
- Pricing: All prices are subject to change without notice. All orders must be paid in full at the time of checkout.
- Order Refusal: We reserve the right to refuse or cancel any order for any reason, including failure to comply with these Terms, suspicion of illegal activity, or inaccuracies in product or pricing information.
6. Final Sale and Strict Return Policy
All sales are considered final. We strictly adhere to a No Return policy.
- No Returns or Exchanges: Due to the nature of the products sold (including safety and regulatory concerns), Firehole will not accept returns, refunds, or exchanges for any reason other than the single exception noted in Section 6. B.
- Sole Exception (Wrong Product Shipped): The only exception is if Firehole ships a product that is different from the one listed on your order confirmation.
- You must notify Firehole within seven (7) days of delivery via email at hello@firehole.com.
- The product must be unused, unaltered, and in its original, sealed condition.
- Firehole will cover the return shipping cost and will either ship the correct product or issue a full refund upon receipt and inspection of the incorrect item.
- FFL Transfer Refusal: If a firearm transfer is refused for any reason (e.g., failed background check, state law prohibition, or customer refusal), the transaction is considered a Final Sale. The Buyer will be responsible for all shipping costs (both ways) and a 25% Restocking Fee of the firearm's purchase price to cover administrative, legal, and FFL holding costs.
7. Links to Third-Party Websites
Our website may contain links to third-party websites that are not owned or controlled by Firehole. We provide these links purely for convenience. Firehole is not responsible for the content, privacy policies, or practices of any third-party websites. The inclusion of any link does not imply endorsement by Firehole of the site or any association with its operators. You access any third-party website at your own risk.
8. Indemnification
- General Indemnity: You agree to indemnify, defend, and hold harmless Firehole LLC, its parent, subsidiaries, and affiliates (specifically including Firehole Arms LLC, Firehole Ordnance LLC, and Dark Hills LLC), and their respective officers, directors, owners, members, employees, agents, successors, and assigns from and against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses (including reasonable attorney fees) arising out of or resulting from:
- Your purchase, ownership, or use of the products sold by Firehole, including any subsequent damage to firearms, optics, suppressors, or related equipment.
- Your failure to comply with any applicable Federal, State, or Local laws.
- Your breach of any of these Terms and Conditions, specifically including the violation of safety protocols or the decision to fire ammunition after a known malfunction.
- Limitation of Liability: IN NO EVENT SHALL FIREHOLE LLC BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PROPERTY DAMAGE OR PERSONAL INJURY, ARISING OUT OF OR RELATING TO ANY BREACH OF THESE TERMS OR THE USE OF OUR PRODUCTS. Our total liability for any claim shall not exceed the actual purchase price paid for the specific product that is the subject of the claim.
9. Electronic Communications
By using this website, you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. Your use of the website constitutes your agreement to deal electronically with Firehole.
10. General Provisions and Contact
- Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law provisions.
- Severability: If any provision of these Terms is held to be invalid or unenforceable, such provision shall be eliminated or limited to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
